Auto Insurance Claim Settlement

What’s a fair offer for my BF’s auto settlement claim?
my BF car was totalled
-he has a lawyer
–he’s on permanent light duty at work and has permanent back injuries
-he’s medical bills are 35k
-the other driver’s policy limit is 500k
-it was the other driver’s fault and he’s insurance has taken full responsiblity and there’s a witness and police report in my BF’s favor
There is no court ordered settlement.
His medical bills are 35K, but is he being treated on a lien basis? Those types of bills are typically inflated since the doctors know that they won’t get as much. They are usually valued at 1/3 or less than the “amount” of the “bill” because insurance companies know they are overinflated.
Did he pay any portion of the medical bills or are the bills covered by insurance? If covered by insurance, then hopefully he has advised his medical insurance company about the lawsuit/claim so they can recover their costs.
Car – again, did insurance pay for the totalling of the car? If so, they have superior rights to the value of the car than the boyfriend. He might be entitled to the difference in the value and/or loss of use. Did he get a rental car?
Has the doctor advised permanent back injuries? How long ago was the accident? When was the lawsuit filed? Who made the determination that his back injuries would never be resolved and he would be on light duty permanently?
I’d say you’re looking at a settlement value of $25,000-100,000, depending on the answer to the above questions.
Your boyfriend should ask his attorney. He has all the information necessary to determine settlement value of the case. Don’t forget that the attorney’s fee (33-40% of the settlement) is taken out first, then the court fees are taken out, then the doctor’s fees/medical bills are taken out, before you even get to the portion that the boyfriend will recover.
