what can I do when the insurance co. trys to use a lesser vehicle with unlisted milage as a price guide?
They sent me a list of trucks 14, of which only 2, had the mileage listed .Absolutely none of them were listed a V-8. Only 3, were listed as auto-trans, only one was a Silverado, none were listed with power doors&windows, etc. If someone could help me with info on how far I can press them, or should I say, how far are the laws governing this area going to back my claims as an insured individual. I don’t want anything more than what is fair. I myself found 37 ads that had all the extras that came with mine, that they insured on/with my vehicle, 18 of which were V-8’s the same year and listed milage (or more),out of those even some of the ones with over 260,000 miles asked $4999.The offer to me <$2500 I apprecieate any legitimate info. Thanks . Oh, they told me they do not use Kelly blue book,NADA,Edmunds, nor any other price guides, how do they expect an estimate to be close to the value of a vehicle if they don't know what to use as a controlbase? So you send them the list you found of 37 ads along with a request to be paid $XXXX. Your research is as good as theirs, perhaps better.
Assuming you are not at fault and the insurance is attempting to settle with you, they owe you the value of your vehicle, adjust for condition, at the time of loss.
What I don’t understand is why you are talking to them. Why isn’t your insurance company working with them on your behalf? Have you asked your agent about all this? If not, do so.
