I rent a house. Tree fell on my car. Who is responsible?

My husband and I rented a house. For three months we have had the smaller members and branches fall from the trees lining the road. On many occasions, we told the owner that something should be done. He always said you look. Now a large portion of the tree fell on my car (05 Altima with insurance) and my husband's old car (61 Chrysler not secure). Your landlord will not cover, our tenant does not cover. My auto policy will cover the Altima, but will have to come up with the deductible and my rates go up. Is the owner responsible for any charges (including tree removal)? Please let me know any advice! Thank you! The old car recently has been presented to us. Who had been in another state. When we bought our policies here, we had the car. And as you said, hindsight is 20/20. Tonight, I learned that the old insurance is about $ 50 a year. Thanks for your input.

It would be much better if you have copies of letters that owner had written to him about the situation of a tree, to show he had knowledge of a pre-existing problem. However, hindsight is 20/20. At this point all I could do was call a certified arborist to give an opinion about why the tree fell. If the tree fell because of high winds, then nobody's fault. If, in the opinion of the arborist should have been obvious to anyone that the tree was a hazard, then you can may have a good case – still need to drag through the court. If the tree was rotten, but you can not prove that the landlord knew, then would not be liable for damages, but would of course be responsible for cleanup. I'm not sure why the owner of owners insurance will not cover damage to your car but your insurance company must state that it was an act of God or something. If neither option sounds good, then you have to leave your insurance will cover the Altima and the risk of their rates go up. The old car was not insured (what's that?) Is something that is going to have to pay for their own pocket to fix, if you choose.
