Re NYS No Fault auto insurance,?

a Cablevision van rear ended my car as I was stopped at a red light. If I go to my doctor, do I give him the other guy’s insur info. I am clueless as to No Fault.

While you are not at fault for this accident, you must submit your medical expenses to your own insurance company. Contact them ASAP, there is a time requirement. They will send you a PIP application that needs to be completed and returned. They will pay the meds under your PIP coverage and then subrogate against the at-fault carrier.

The purpose of No-Fault has nothing to do with ‘fault’ actually. It was designed to allow an injured party to recover for medical expenses, lost wages and replacement services against their own policy directly. Fault does not have to be established. PIP pays regardless of fault.

The trade off is you cannot file a claim/suit for “pain & suffering” unless your sustained a “serious injury” in the state of NY. The thresholds vary from NF state to NF state.
